Paragraph 1

Notice of Identity and Fiduciary Capacity and Reservation of Constitutional Rights

Paragraph 2

Court or agency: [insert recipient]
Matter and case or reference number: [insert]
To: [identify recipients]
From: Chris Magis Nero
Date: [insert service date]

Paragraph 3

I submit this notice to identify myself and my stated representative capacity, preserve applicable constitutional rights, and request review of the specific conduct identified below. I request that this notice and its supporting exhibits be included in the record of this matter.

Paragraph 4

Identity and documented capacity

Paragraph 5

I am Chris Magis Nero, previously known as Christopher Karls Sisneros, a natural person. I use the expression natural man to describe myself as a human being. I assert my own rights in my individual capacity.

Paragraph 6

Where this matter concerns an estate or trust, I also identify the following claimed representative capacity: [executor, personal representative, administrator, or trustee]. Estate or trust name: [insert exact name]. The instrument or appointment establishing that authority, its date, issuing court if applicable, and scope are: [identify and attach Exhibit A]. I request that the record accurately distinguish my individual capacity from any representative capacity established by that evidence.

Paragraph 7

For an Arizona decedent estate, A.R.S. § 14-3701 provides that a personal representative’s duties and powers commence on appointment; § 14-3703 addresses fiduciary duties and standing. My claimed capacity is presented for review against the attached source of authority.

Paragraph 8

Constitutional protections and government obligations

Paragraph 9

I invoke the applicable protections of the United States Constitution, including the Fourth Amendment concerning searches and seizures, the Fifth Amendment concerning federal due process and takings, and the Fourteenth Amendment concerning state due process and equal protection. Where applicable, I also preserve petition rights under the First Amendment and criminal defense protections under the Sixth Amendment.

Paragraph 10

In Arizona, I invoke Article II, §§ 2, 3(A), 4, 8, and 32: protection of individual rights, constitutional supremacy, due process, protection of private affairs and the home, and the mandatory character of constitutional provisions. Article II, § 17 applies where the facts establish a compensable taking or damaging of property.

Paragraph 11

The Slaughter-House Cases, 83 U.S. 36, 74 (1873), and Saenz v. Roe, 526 U.S. 489, 504 (1999), recognize distinct state and national citizenship capacities. I rely on the rights applicable to this matter and request protection of those rights in the exercise of official authority.

Paragraph 12

Specific conduct and grounds for objection

Paragraph 13

Official or entity responsible: [insert]
Action, order, detention, search, seizure, or record entry challenged: [describe]
Date and location: [insert]
Right or legally protected interest affected: [identify]
Specific reason the conduct lacked authority or violated that right: [state facts]
Evidence: [identify exhibits and relevant portions]

Paragraph 14

Notice and requested corrective action

Paragraph 15

Upon receipt, you are notified of the identity, claimed capacity, supporting records, and specific objection presented here. I request that the responsible official review the objection and act consistently with applicable constitutional and statutory duties. Receipt and any response should be documented in the record.

Paragraph 16

I request identification of the legal authority relied upon for the challenged conduct and, where jurisdiction is specifically disputed, the constitutional or statutory grant of jurisdiction and the facts satisfying its requirements. Please identify any disputed appointment, capacity, ownership, or party identification and the documentary basis for that dispute.

Paragraph 17

I request preservation of relevant orders, filings, communications, recordings, accountings, and other records in your possession or control relating to the conduct described above. The specific correction or relief requested is: [state a definite request]. In a court proceeding, I request that any accompanying properly presented motion be decided under the applicable rules.

Paragraph 18

Public duties and preservation of remedies

Paragraph 19

Public officials must exercise their authority consistently with applicable law. I object to the specified conduct as an alleged violation of public duties to the extent shown by the evidence. If an actual fiduciary duty to the estate or trust is alleged, its source and the particular breach are: [identify statute, appointment, trust instrument, undertaking, or other recognized legal basis, and supporting facts].

Paragraph 20

I reserve available objections and remedies, including relief under 42 U.S.C. § 1983 where its requirements are met. Any liability or remedy remains subject to the governing law, proof, applicable defenses, immunities, and procedural requirements. This notice does not itself establish a breach, create a fiduciary relationship, stay proceedings, extend deadlines, or substitute for a required motion or claim notice. Silence is not treated as consent or an admission.

Capacity for this matter: [individual and/or documented representative capacity]

Paragraph 22

Certificate of service

Paragraph 23

I certify that on [date] I served this notice and the identified exhibits on [each recipient and address] by [authorized method]. Proof of service or delivery: [identify].

Paragraph 24

Instructions and Authority References

Paragraph 25

How to use the notice

Paragraph 26

Keep these instructions out of the filed or served notice. Make a separate completed copy of pages 1 and 2 for each matter. Replace all bracketed fields, use that court’s caption and formatting requirements, and attach only relevant supporting exhibits. Describe observable facts; identify disputed conclusions as allegations. Sign only after confirming the completed statements.

Paragraph 27

Attach the actual source of representative authority. Use executor or personal representative for a decedent estate only where supported by the governing appointment and law. Use trustee where a trust instrument and applicable law establish that office. A notice stating capacity does not itself appoint a representative or authorize representation of other persons in court.

Paragraph 28

For a jurisdiction ruling, use the notice as supporting material for a motion identifying a specific jurisdictional defect under the rules governing that case. In an Arizona superior court civil action, Rule 12(b)(1) addresses subject-matter jurisdiction and Rule 12(b)(2) addresses personal jurisdiction. Criminal, municipal, justice court, and civil traffic matters require their own applicable rules. State and national citizenship distinctions, the phrase natural man, and an estate designation alone do not establish such a defect.

Paragraph 29

For service, follow the rules applicable to the proceeding; certified mail alone is not a universal substitute. Keep delivery evidence. Continue to meet existing deadlines unless the court grants relief. If seeking damages against an Arizona public entity or employee, separately evaluate any required notice of claim and its deadlines, including A.R.S. § 12-821.01.
