1 This document outlines steps for challenging and discharging utility bills using consumer law and administrative procedures. What Not to Do When Discharging Utility Bills Several common mistakes and misconceptions to avoid: • Do not use your Social Security number as a routing number to pay utility bills. This is a common false claim; the SSN is associated with an estate/trust but is used to track debt/assets, not to pay for things. It might temporarily work but will often get reversed. • Do not send an invalid coupon. You must properly endorse your coupon using 31 CFR 328.5 and 31 CFR 328.6. Endorsing it properly is only part of the process. • Do not ignore follow-up notices from the utility company. You must respond to them and call them out on their attempts to collect on the debt after you've sent a coupon. • Do not try to force a discharge without an agreement or acceptance. Sending an instrument like a coupon is considered an offer, which requires an acceptance, refusal, or counteroffer under contract law. • Do not just stop paying your bills entirely. Until the contract is challenged, simply stopping payment can be argued as a breach of contract. • Do not attempt this process if you are not willing to go the distance (i.e., be ready to go to court and challenge them). • Do not rush the process. This process will not immediately discharge your debt in the first month. Step-by-Step Process to Lawfully Challenge and Discharge a Utility Bill The process involves building a contractual and legal case to challenge the obligation and avoid disconnection. Phase 1: Establish the Challenge and Tender Payment 1. Send a Conditional Acceptance or Notice of Tender: This initiates the challenge and asks the utility company to provide specific proof. “See examples Chris send to the group”
2 o Include a Tender for Discharge: This can be a remittance coupon (one of the simplest negotiable instruments), a private instrument stating "accepted for value," a promissory note, or a notarized letter of tender. o Endorse the Coupon Properly: If using a remittance coupon, ensure it is correctly endorsed according to 31 CFR 328.5 and 31 CFR 328.6. 2. Request Validation and Proof (in the Conditional Acceptance): Ask for the following documentation: o A full itemized accounting. o Proof of contract with your wet ink signature. o Proof that they paid for the utilities (electricity, water, etc.) or advanced consideration. o The CUSIP or billing bond reference. 3. Maintain Honor and Communication: o Include Pro-Tip Language: Add language like, "This is not a refusal to pay. I'm willing to settle any lawful obligation upon validation of claim and full accounting under GAP". This helps build a case that you are not refusing to pay, but seeking validation. o Keep Communication Open: Call and notify the utility company that you are investigating a bill discrepancy before they send a final disconnection notice. o Consider a Partial Payment: Make a partial or some level of payment to avoid a non-payment status and help prove you are not avoiding the debt, but seeking remedy. Phase 2: Follow-Up and Dispute Resolution 4. Respond to Refusal with Notice of Dishonor: o If they refuse your tender, UCC 3-603 states that if a tender of payment is made and refused, there is a discharge. o If they reject your tender without a proper rebuttal, follow up by sending a Notice of Dishonor. Notify them of the UCCC.
3 5. Use the Affidavit Process (Long-Term Strategy): If they ignore your requests, you can use a series of notarized documents to create legal standing: o Send an Affidavit of Non-Response. o Send a Certificate of Dishonor. o Send a Notice of Estoppel and a Claim of Discharge. o This commercial affidavit process can take 3 to 4 months. An unrebutted affidavit stands in truth as commerce. 6. File Formal Complaints to Avoid Disconnection: If they attempt to shut off your utilities, use regulatory agencies to create a paper trail and mediate the dispute. o File a complaint with the Public Utility Commission (PUC) (or similar state agency). Ask them to open a case or mediate before the service is shut off. o You can also file complaints with the FTC and CFPB (especially for debt collection threats). The FCC is for cell phone/telecom/internet disputes. o Use the Legal Angles to Buy Time: You can argue that you are in a financial hardship, which many states have protections for. You can also argue that denying access to essential services (water, power, heat) without due process creates a constitutional or tort-based liability. o Document Everything: Use this time to document their harm, breach of contract, or failure to validate. 7. Consider a Temporary Restraining Order (TRO): You can file a TRO in local court and send a notice of harm and liability to break down how they have harmed you.
