Dear Mr. Nero
This letter constitutes the final response to your Freedom of Information Act (FOIA)
requests to the Executive Office for the Organized Crime Drug Enforcement Task Forces
(OCDETF), dated November 26, 2024, and received by OCDETF on the same day. Your request
seeks records concerning “Official Loyalty Oath of Office (ideally, Physical & Digital copy)
Request Category: Federal U.S. District of Arizona Court Records of-for Judge-Magistrates”, with
further details in the original request. Your request has been assigned FOIA tracking number
FOIA-OCD2025-0023.
The records you describe in your FOIA request do not appear to be maintained by
OCDETF. OCDETF is the centerpiece of the Attorney General’s strategy to combat transnational
organized crime and to reduce the availability of illicit narcotics in the nation by using a
prosecutor-led, multi-agency approach to enforcement. More information regarding OCDETF can
be located at https://www.justice.gov/ocdetf/about-ocdetf. The records you seek likely fall under
the purview of a local law enforcement agency or a different federal component.
Your request for agency records, as stated in your correspondence, cannot be processed at
this time. As an initial matter, the FOIA specifies a request for agency records must reasonably
describe the records sought. 5 USC § 552 (a)(3)(A). A description of a requested record is
sufficient if it enables a professional agency employee familiar with the subject area to locate the
record with a "reasonable amount of effort.” See Truitt v. Dep't of State , 897 F.2d 540, 544- 45
(D.C. Cir. 1990); Ferri v. Dep’t of Justice, 573 F. Supp. 852, 859 (W.D. Pa. 1983). A federal
agency is not required to a conduct wide-ranging, unreasonably burdensome search for responsive 2 records to a FOIA request. See Nation Magazine v. U.S. Customs Serv., 71 F.3d 885, 892 (D.C. Cir. 1995); AFGE v. U.S. Dep't of Commerce , 907 F.2d 203, 209 (D.C. Cir. 1990). Your FOIA request, as submitted, does not reasonably describe the records sought from OCDETF. If you have any questions about the status of your request, please feel free to contact the OCDETF FOIA Public Liaison via the information at https://www.justice.gov/ocdetf/ocdetf-foia. Please include the FOIA tracking number provided above in all communications. Additionally, you may contact the Office of Government Information Services (OGIS) at the National Archives and Records Administration to inquire about the FOIA mediation services they offer. The contact information for OGIS is as follows: Office of Government Information Services, National Archives and Records Administration, 8601 Adelphi Road- OGIS, College Park, Maryland 20740-6001, e-mail at ogis@nara.gov; telephone at 202-741-5770; toll free at 1- 877-684-6448; or facsimile at 202-741-5769. If you are not satisfied with OCDETF’s determination in response to this request, you may administratively appeal by writing to the Director, Office of Information Policy (OIP), United States Department of Justice, 441 G Street, NW, 6th Floor, Washington, D.C. 20530, or you may submit an appeal through OIP's FOIA STAR portal by creating an account following the instructions on OIP’s website: https://www.justice.gov/oip/submit-and-track-request-or- appeal. Your appeal must be postmarked or electronically transmitted within 90 days of the date of my response to your request. If you submit your appeal by mail, both the letter and the envelope should be clearly marked "Freedom of Information Act Appeal." If possible, please provide a copy of your original request and this response letter with your appeal. Sincerely, Kevin D.
